How do I know whether I’ve abandoned my permanent resident status? (I-90)
Don't lose your status as a lawful permanent resident.
According to the USCIS, there are several ways that you can lose your status as a lawful permanent resident (green card holder) 1. USCIS can terminate your status sue to fraud or other immigration violations 2. An immigration judge can terminate your status if they issue a final removal order against you 3. You can intentionally abandon your status if you: a. Move to another country and live there permanently b. Stay outside of the US for an extended period of time without getting a re-entry permit or a returning resident visa c. Do not file taxes while living outside of the US d. State that you are a “non-immigrant” on your tax returns. If you have any questions about whether or not you have abandoned your status you should speak to an immigration attorney. The American Immigration Lawyers Association can assist you in finding an immigration attorney in your area. Go to www.ailalawyer.com for more information.
